ZF Meritor LLC v. Eaton Corp.

David DeRamus provided trial testimony in ZF Meritor LLC v. Eaton Corp., a monopolization case involving heavy-duty truck components. His testimony defined the relevant antitrust market, assessed whether a market participant had monopoly power, evaluated the harm to competition from certain contracts and the performance of those contracts, and estimated damages. The jury verdict on liability was in favor of Bates White's client and was upheld on appeal; prior to the damages phase of trial, the parties agreed to a $500 million settlement. (ZF Meritor v. Eaton Corp., 696 F.3d 254 (3d Cir. 2012), cert denied, 133 S.Ct. 2025 (2013)).
