Assessing the value of PFAS claims
Per- and polyfluoroalkyl substances (PFAS) include PFOA, PFOS, GenX, and many other substances. Widely used in manufacturing processes and consumer products, these man-made chemicals break down slowly over time, earning them the moniker “forever chemicals.” Varying levels of PFAS have been detected in water, air, and soil at locations across the globe.
Bates White has helped numerous companies assess their PFAS exposure. Clients have retained us across an array of litigation and business situations to assess a variety of PFAS claims, including claims related to personal injury, public water systems, soil remediation, property damage, private well remediation, and medical monitoring. In one class-action case, we provided economic analysis on several claim types stemming from a single manufacturing facility. In a bankruptcy proceeding, we provided economic analyses of all the above claim types for an AFFF manufacturer. In merger and acquisition contexts, we have helped the parties understand potential financial risk from future PFAS litigation and remediation, as well as the available insurance to address those risks.
Our in-depth experience helps companies navigate the myriad of issues surrounding PFAS-related expenditures, with the analysis depending on the client and situation. Our insights have helped clients develop educated expenditure forecasts, reach resolution, and make informed business decisions.
