Work for client ACE INA Insurance results in settlement
Andrew Evans was retained by O’Melveny & Myers on behalf of ACE INA Insurance in Irving Oil Limited and Highlands Fuel Delivery, LLC v. ACE INA Insurance. Irving is a Canadian company that produces gasoline and other fuels; its US-based subsidiary Highlands Corp. is responsible for the transportation, marketing, and delivery of fuel within the northeastern United States. Between 2008 and 2013, Irving and Highlands reached settlements with multiple municipal water districts over their use of methyl tert-butyl ether (MTBE), a gasoline additive that causes groundwater contamination.
The companies subsequently initiated litigation to recover a portion of their MTBE losses from ACE, an insurer that issued separate policies shared to Irving and Highlands. Ultimately, the parties settled, with Bates White provided settlement support to ACE.
