Relevant market definition and market power in ChromaDex litigation

Randy Heeb submitted an expert report on behalf of ChromaDex in its litigation against its former customer Elysium. ChromaDex is the exclusive licensee of certain patents for nicotinamide riboside (NR), a nutritional supplement branded as Niagen®, which is marketed for its potential anti-aging (or healthy aging) properties. Elysium alleges that ChromaDex committed patent misuse by requiring Elysium and others to include ChromaDex’s trademarks on their supplement labels as a condition of buying and using the NR ingredient in their supplements. Dr. Heeb’s opinion addressed issues of relevant market definition and market power.
