Renewable fuels markets analysis

Collin Cain submitted an expert declaration supporting a Motion for Stay of Agency Action filed against the US Environmental Protection Agency (EPA) by Producers of Renewables United for Integrity Truth and Transparency (PRUITT) in the US Court of Appeals for the DC Circuit. The petitioner (Bates White’s client) sought a stay of EPA actions granting exemptions to small refineries otherwise obligated under the Renewable Fuel Standard (RFS) program. Mr. Cain testified that the substantial increase in grants of exemptions to small refineries has caused a reduction in the minimum renewable fuel volumes that the EPA had previously established under RFS, undermining the basis of the program’s support for biofuel production and causing financial harm to producers.
