Bates White presents at FTC workshop on certificates of public advantage

Partner Cory Capps and Manager Laura Kmitch will participate in a Federal Trade Commission workshop “A Health Check on COPAs: Assessing the Impact of Certificates of Public Advantage in Healthcare Markets.” The workshop will examine the impact of certificates of public advantage (COPAs) on prices, quality, access and innovation for healthcare services. COPAs are regulatory regimes that state governments adopt to immunize mergers from antitrust scrutiny; states increasingly use COPAs to allow hospital mergers to proceed in spite of antitrust concerns, assuming that state regulatory oversight will mitigate the effects resulting from the elimination of competition to allow hospitals to achieve efficiencies.

Dr. Capps will present on the panel “Completed COPAs: Reviewing the Mission Health and Benefis Health COPAs.”  Ms. Kmitch will present in the session “Retrospective and Empirical Studies of COPAs.”
