In her role as expert witness, Dr. Meyendorff submitted an expert report on liability and damages. She provided analysis of market definition, providing evidence that do-it-yourself options and adjacent software products were not close substitutes. She provided further analysis to illustrate Defendant’s market power and to demonstrate the anticompetitive effect of Defendant’s conduct. Dr. Meyendorff’s damage model accounted for the plaintiff’s likely market penetration but for the defendant’s anticompetitive conduct. The case settled before Dr. Meyendorff was deposed.
