Summary
In his work conducting economic analyses of competition, Naibin Chen has focused on advocacy and litigation work on behalf of private clients. His experience includes pre-merger analysis, merger advocacy, price-fixing, exclusionary restrictions, and anticompetitive conduct. His works spans a wide range of industries, including agricultural, chemical, healthcare, payment, pharmaceutical, and technology. Naibin specialized in industrial organization and applied microeconomics in his doctoral work. - On behalf of VMWare, in conjunction with its $61 billion acquisition by Broadcom, supported the merging parties’ advocacy efforts. The transaction closed in 2023.
- Supported analyses of customer choices of health plans and effects of introducing new health plans in a study authored by Profs. Leemore Dafny and Robin Lee and Dr. Zenon Zabinski on behalf of the California Public Employees’ Retirement System (CalPERS).
- Supported analyses on customer demand estimation for broadcasting programs on behalf of the National Association of Broadcasters in In re Distribution of Cable Royalty Funds.
- On behalf of a pharmaceutical company, processed large and complex company data and constructed comprehensive data sets for analysis; analyzed sales, chargebacks, and rebates on the product level; and calculated net prices.
- On behalf of an agricultural chemical company facing an investigation regarding the competitive effects of loyalty rebates, conducted industry background and product research; analyzed various data sets using client and public data; analyzed market definition, market shares, price trends, and product margins; and supported expert work on a white paper submission.
