  • Served as a consulting expert and led the team supporting the testifying expert in Regeneron Pharmaceuticals, Inc. v. Amgen Inc., a matter regarding alleged foreclosure from the PCSK9 inhibitor market through anticompetitive bundling of pharmacy benefits manager rebates. 
  • Led the team supporting the expert on damages on behalf of a pharmaceutical manufacturer defendant concerning allegations of inappropriate marketing leading to lost profits for plaintiff hospitals.
  • Co-led the team supporting the expert on behalf of a health insurer in its acquisition of a long-term care pharmacy. Submitted advocacy to the FTC regarding horizontal overlap and vertical competitive effects and assisted with second request compliance. The transaction was cleared without conditions.
  • Supported testifying experts on behalf of a health insurer regarding alleged violations of the False Claims Act in connection with Medicare Part D formulary design.
  • Supported the testifying expert on behalf of Actelion in Government Employees Health Association (GEHA) v. Actelion Pharmaceuticals LTD. regarding market definition and market power in connection with antitrust allegations of delayed generic entry.
  • Supported the testifying expert on causation on behalf of a manufacturer defendant concerning allegations of inappropriate marketing of prescription opioids.
  • In Sandoz Inc. and Raregen, LLC v. United Therapeutics Corporation and Smiths Medical ASD, Inc., provided support for the expert report of Dr. Eric Gaier regarding issues of market definition, market power, and competitive effects on behalf of United Therapeutics and Smiths Medical in connection with plaintiffs’ allegations of exclusionary contracts in violation of antitrust laws.
  • In Veeva Systems Inc. v. IQVIA Inc., supported the testifying expert on behalf of Veeva on issues of market definition, market power, and competitive effects regarding monopolization of data and data management software for pharmaceutical companies.
  • Supported the expert in two related intellectual property matters on behalf of a pharmaceutical manufacturer alleging infringement of patents on its brand-name drug against a generic manufacturer.
  • In In re Determination of Rates and Terms for Making and Distributing Phonorecords, supported the expert in preparing testimony on behalf of Spotify USA Inc. regarding royalty payments under Section 115 of the Copyright Act.
