Bates White expert provides competitive analyses in Deborah Heart and Lung v. Our Lady of Lourdes et al.

The case Deborah Heart and Lung v. Our Lady of Lourdes et al. involved a dispute between Deborah Heart and Lung Center and Virtua Health, two New Jersey hospital systems. Deborah alleged that Virtua’s 2019 acquisition of Our Lady of Lourdes Hospital, an acute care hospital that provided emergency services, was a violation of an agreement underlying Deborah’s earlier joint venture with Lourdes.

Kutak Rock retained Cory Capps on behalf of Virtua Health. He provided various analyses to evaluate the competitive landscape for inpatient specialty services and the competitive effects of the joint venture; he also assessed the economic validity of Deborah’s damages claims. Dr. Capps submitted a rebuttal report and provided deposition testimony; the case settled prior to trial.
