Anna Meyendorff was retained on behalf of the defendants in Genus Medical Technologies, LLC v. Bracco Diagnostics, Inc., E-Z-EM, Inc., E-Z-EM Canada, Inc., and United Minerals and Properties, Inc. The case involved allegations that the defendants were engaged in anticompetitive exclusive dealing.

In her role as expert witness, Dr. Meyendorff submitted an expert rebuttal report and was deposed. She testified that the relationship between the defendants was pro-competitive as it combined complementary assets, allowing them to jointly produce a key pharmaceutical ingredient that neither party was able to produce alone. Dr. Meyendorff also demonstrated that the plaintiff’s expert failed to properly define markets, failed to prove the defendants’ alleged market power, failed to properly consider pro-competitive benefits of the alleged anticompetitive conduct, and miscalculated damages. The case settled before going to trial.
