Joseph Farrell was retained as an expert on behalf of the consumer class in Klein et al. v. Meta Platforms, Inc. The consumer class alleges that Meta intentionally deceived Facebook users about the data protections it provided to them, in order to diminish competition and obtain dominance in markets characterized by strong network effects and high barriers to entry. Professor Farrell submitted an expert report in 2023 during the class certification phase and two expert reports in 2024 during the merits phase of the case. In those reports, he defined a relevant antitrust product and geographic market for analyzing competitive effects of Meta’s alleged conduct, identified its substantial participants, and estimated their shares. Professor Farrell was subsequently deposed on the opinions in his merits reports. The case is ongoing.
