In May 2026, Bates White client Allegiant Air successfully completed its acquisition of Sun Country Airlines, combining two low-cost, leisure-focused airlines with complementary networks.
In January 2026, Allegiant announced its proposed acquisition. Allegiant retained Nicholas Hill and a Bates White team to conduct analyses of the likely competitive effects of the transaction. The team also assisted Allegiant and its outside counsel at Skadden, Arps, Slate, Meagher & Flom LLP with responses to information requests from the US Department of Justice (DOJ) during its investigation. On March 16, 2026, the DOJ granted early termination to the waiting period under the Hart-Scott-Rodino Antitrust Improvements Act without issuing a Second Request. The merger was completed on May 13, 2026.
