In re Thomas Jefferson University and Albert Einstein Healthcare Network

Cory Capps was retained on behalf of defendants in litigation brought by the Federal Trade Commission (FTC) to enjoin the proposed merger of Jefferson Health with Albert Einstein Healthcare Network. He evaluated the market definition and competitive effects, and analyzed the inpatient general acute care services market to evaluate the likely competitive effects of the merger, accounting for merger-specific efficiencies, cost savings, and other procompetitive effects. Dr. Capps testified at the preliminary injunction hearing in September 2020 and, after the district court denied the FTC's request for a preliminary injunction and the Third Circuit declined to grant an emergency stay, the FTC dropped its challenge to the merger.
