Bates White provides expert testimony and trial support in fraud case victory
Ben Scher testified before a jury in federal court in the United States v. Kenia Valle Boza matter on behalf of defendant Kenia Valle Boza. Ms. Valle Boza was a former employee of HealthSun Health Plans, Inc. The government alleged that she orchestrated a scheme to cause the coding of fraudulent diagnoses to increase the risk-adjusted amounts the government paid to HealthSun, a Medicare Advantage plan.
Mr. Scher served as an expert witness in healthcare data analysis. He analyzed millions of records of diagnosis data and testified about the patterns he observed, which were not consistent with the alleged fraud scheme. In addition, Mr. Scher and Emma Cohen supported attorneys at McDermott Will & Emory and Fridmen Fels & Soto throughout trial.
Following the nine-day trial, a jury found Ms. Valle Boza not guilty of all charges.
