Randy Chugh, PhD

  

Randy Chugh has been retained as an expert by private litigants and by the DOJ on multiple matters, including mergers in the airlines industry and in advanced manufacturing technologies. He has also led teams supporting experts in a wide variety of antitrust matters, including monopolization matters (e.g., on United States et al. v. Google LLC (Ad tech)), private litigation (e.g., Genus Medical Technologies, LLC v. Bracco Diagnostics), and state merger enforcement (e.g., Washington’s and Colorado's challenges of Kroger's acquisition of Albertsons.) Randy was previously an Economist with the DOJ's Antitrust Division, where he was recognized for his contributions to economic analysis and litigation support. 

   

Eric Emch, PhD

   

Eric Emch recently testified for the defense in Moskowitz v. American Express Company on market definition, market power, and competitive effects issues, with the jury ruling in favor of American Express on all antitrust counts. His recent work has included a number of digital platform matters, including co-leading the team supporting the plaintiff’s expert in Epic Games v. Google. Eric draws from a deep experience in antitrust across a variety of topics and in a variety of industries, going back to his work at the DOJ and OECD prior to joining Bates White.

Eric is currently Vice Chair of the Intellectual Property Committee of the American Bar Association and has taught Industrial Organization at Georgetown University and econometrics in Johns Hopkins University’s Master’s of Applied Economics Program. 

    

Rachel Grinberg, PhD

  

Rachel Grinberg has been retained as an expert in competition litigations, arbitration proceedings, and insurance coverage disputes. She has led teams supporting experts in direct-action plaintiff price-fixing cases, and recently co-authored a chapter with Leslie Marx in the book Cartels Diagnosed: New Insights on Collusion. Dr. Grinberg deploys data analysis and economic tools to develop creative, rigorous solutions to her clients' most pressing problems. 

   

Kevin Pflum, PhD

  

Kevin Pflum has been retained as an expert in healthcare merger and acquisition cases before state and federal enforcement agencies, including HCA Healthcare’s proposed acquisition of Steward Health Care’s five Utah hospitals and the proposed merger between Lifespan and Care New England. He recently helped secure approval of Union Hospital’s and Terre Haute Regional Hospital’s COPA application in Indiana; merger clearance for Beaumont-Spectrum (now Corewell Health); and clearance for Health Care Service Corporation (HCSC) to sell its Medicare assets to Cigna.

Kevin has also led teams supporting experts in major healthcare mergers, including in Jefferson-Einstein’s successful defense against the FTC’s attempt to enjoin their merger and in the FTC’s successful attempt to enjoin the Hackensack-Englewood merger.

In addition to his extensive experience with the healthcare sector, Kevin has also performed economic analyses for a variety of industries including pharmaceuticals, cable TV, building materials, software, and airlines. Prior to joining Bates White, he was an assistant professor of economics at the University of Alabama, where he taught graduate and undergraduate economics courses.

   

Mathis Wagner, PhD

  

Mathis Wagner has served as both a testifying expert and lead consulting expert on numerous antitrust and consumer protection cases. He focuses on helping clients evaluate the merits of claims, quantify damages and civil penalties, and address class action issues in disputes involving monopolization, price fixing, and exclusionary practices such as noncompete agreements.

Mathis is an expert in economic and statistical analysis, specializing in combining data-driven insights with a deep understanding of how markets interact and function. Mathis is committed to delivering rigorous analyses that withstand scrutiny in litigation. He excels at communicating his findings in a clear, concise, and compelling narrative that his clients can rely on.

He applies his expertise across a broad range of industries, including technology, entertainment and sports, education, life sciences, and healthcare. His versatile knowledge allows him to tailor his approach to the unique dynamics of each sector, ensuring a comprehensive and impactful analysis for his clients.

Before joining Bates White, Mathis was a faculty member at Boston College, where he taught microeconomics and labor economics courses at both the undergraduate and graduate levels.
