In re Google Play Store Antitrust Litigation wins GCR award

Bates White is pleased to announce that In re Google Play Store Antitrust Litigation has won Global Competition Review’s (GCR) 2024 “Litigation of the year – Non-cartel prosecution” award. Bates White was retained on behalf of Epic Games, which alleged that Google monopolized the market for app distribution on Android smartphones.

Partner B. Douglas Bernheim played a key role in the case, submitting analyses of the antitrust allegations that assessed market definition, market power, competitive effects, and consumer harm from Google’s conduct. He testified twice in the last week of the four-week jury trial, and his rebuttal testimony ended the proceedings until closing arguments one week later. Epic Games secured a unanimous jury verdict finding Google liable for monopolizing Android app distribution and in-app purchases in a global market excluding China.
