On behalf of the New York State Attorney General, a Bates White team helped evaluate the competitive effects of the $26 billion Sprint T-Mobile merger. The team supported two expert witnesses for the coalition of plaintiff states in litigation over the proposed merger and conducted analyses of the likely competitive effects; the alleged efficiencies; and the proposed entry of DISH, which the Department of Justice required Sprint to divest as part of its merger approval. The case represented one of the few times that state Attorneys General sought to block a merger of national scope without the support of one of the federal antitrust agencies.
