In Takeda Pharmaceutical Company Limited v. Zydus Pharmaceuticals (USA) Inc., Eric Gaier testified on behalf of Takeda concerning market definition, market power, competitive effects, and damages in connection with Zydus’s antitrust counterclaims. The court granted Takeda’s motion for summary judgment on the antitrust counterclaims.

On behalf of the New York State Attorney General, a Bates White team helped evaluate the competitive effects of the $26 billion Sprint T-Mobile merger. The case represented one of the few times that state Attorneys General sought to block a merger of national scope without the support of one of the federal antitrust agencies.
