Damages and wrongful discharge


The Labor and Employment Practice has calculated damages in many cases with claims specific to a single plaintiff, such as wrongful discharge. Our approach in these cases is to calculate both an actual and a but-for sequence of earnings and to base damage calculations on a comparison of these two sequences. Characterization of both sequences requires an understanding of modern labor economics as well as a familiarity with the government statistical sources needed as inputs to these calculations. With extensive experience in this area, including previous positions as academics and with federal statistical agencies, Bates White professionals are well prepared to handle this type of case.
