A valid patent provides its owner with the right to exclude others from using the invention claimed in that patent. When a company does use that invention without the permission of the patent owner, it has infringed on the patent. A patent owner is entitled to damages, including lost profits and reasonable royalties, to compensate for the infringement.
Douglas Frank has worked on numerous patent infringement cases across wide array of industries, from communications and media to pharmaceuticals; he has worked on behalf of both plaintiffs and defendants.
In one case prior to Bates White, Dr. Frank assessed damages in a communications case regarding alleged infringement of wireless patents; the jury awarded the patent holder the exact amount of the proposed damages. In another case, Dr. Frank assessed lost profits and reasonable royalties from alleged infringement of patents for a branded biologic drug; in that case the jury awarded the patent holder $175 million. A third case involved work on behalf of a defendant in the agriculture chemicals industry. The jury awarded the plaintiff a fraction of the damages it sought.
