Expert testimony provided in Alta Wind v. United States Section 1603 matter

Providing expert testimony on behalf of defense in Alta Wind I Owner Lessor C, et al. v. United States, an ongoing matter in the U.S. Court of Federal Claims (COFC 1:13-cv-00402-RTH). Plaintiffs seek nearly $206 million in additional payments pursuant to Section 1603 of the American Recovery and Reinvestment Act of 2009, which provided for a cash grant in lieu of tax credit for certain qualified investments in renewable energy property, including wind power projects. Dr. George’s two expert reports addressed whether plaintiffs’ claimed cost basis properly excluded any intangible, grant-ineligible property and whether the U.S. Treasury should award any additional amounts. He was deposed twice and testified at trial July 23, 24, and 28, 2025. A decision is expected in 2026.
