For example, in one case, Dr. Frank conducted quantitative analysis and market analysis to assist in estimating a technical evaluation service’s lost profits damages in litigation involving a competitor’s unauthorized use of copyrighted evaluation protocols and reports. In litigation involving the unauthorized use of copyrighted content by an online platform, he performed quantitative and market analysis to assist in estimating lost profits damages to a standards-developing organization. Dr. Frank has also collaborated with an academic affiliate in using text similarity scoring algorithms to demonstrate that the defendant’s language came from the client’s works and not prior works authored by third parties.
