Bates White was retained on behalf of Aldrich Murray in In re Aldrich Pump LLC et al. Bates White testified on behalf of the debtors in a hearing relating to discovery of information from a variety of asbestos trusts. The dispute, which took place in the context of broader discovery battles in the North Carolina asbestos bankruptcies, concerned whether the debtors would receive full access to information they requested from the asbestos trusts or whether a sample would be preferable (from a cost-benefit standpoint). The testimony focused on the importance of having full information for accurately determining payment categories in the debtors' eventual trust, as well as for ensuring equitable treatment for future claimants relative to current ones, and the lack of cost savings from sampling in a context where data are already readily available in an electronic format. The judge ruled in favor of the debtors, positively citing Bates White's testimony.
