JOEL E. SIMKINS, JD, MBA

Principal

Joel E. Simkins provides key legal and economic analysis in complex antitrust, fraud, and securities litigation across a range of industries and forums. Mr. Simkins leverages his legal background and his experience applying economics to antitrust and financial issues to lead forensic document review, develop strategic economic arguments behind engagements, compile industry and company research, and draft expert reports. He has worked on several high-profile antitrust litigation matters, including Enron litigation and AMD v. Intel.

Prior to joining Bates White, Mr. Simkins worked as a Senior Consultant at PricewaterhouseCoopers and at Hagler Bailly Consulting. He practiced law at Dechert LLP (formerly known as Dechert, Price & Rhoads) and at Bell Atlantic.

Selected Experience

  • Supported Professor B. Douglas Bernheim, on behalf of AMD, in the landmark microprocessor antitrust case AMD v. Intel in the evaluation of pertinent evidence and in the production of his expert report. Led forensic review of documents detailing Intel’s relationships with major computer vendors in support of the economic theory that the relationships were harmful to competition. Before the case was brought to trial, the parties agreed to a $1.25 billion settlement.
  • Supported the expert work of Professor B. Douglas Bernheim on behalf of the Enron Creditors Recovery Corp. (Enron). Determined impact of investment banks’ role on value of Enron’s major assets. Work resulted in a $1.7 billion settlement for our client.
  • Developed economic arguments and factual record in support of a bulge-bracket investment bank sued over its alleged complicity in the failure of its client to disclose its true financial condition prior to its acquisition of a subsidiary of the plaintiff. Bates White’s damages analysis led to the reversal of one of the largest damages awards ever won by a single plaintiff and a judgment in favor of the investment bank.
  • Developed economic arguments and documentary evidence establishing factual basis for holding financial institutions liable for their role in the bankruptcy of a top 10 cable company. As testifying and consulting experts, Bates White evaluated claims that these institutions aided and abetted breach of fiduciary responsibility and accounting fraud committed by company insiders.
