David Osinski has extensive experience applying economic analysis
to antitrust and regulatory litigation matters presented before the
U.S. Department of Justice, the Federal Trade Commission, and various
courts. His analyses cover a wide range of industries, including
medical devices, telecommunications/media, specialty chemicals,
consumer products, transportation, feed additives, and alcoholic
beverages.
Dr. Osinski has experience with economic issues relating to firm
conduct, market power, competitive effects, and market definition.
In the area of monopolization, Dr. Osinski has analyzed the
competitive effects of a variety of business practices, including
bundled rebates, aftermarket sales programs, and the use of
intellectual property. In the area of price-fixing, he has
performed class certification and damages analyses in various cases,
including the largest price-fixing litigation in U.S. history. Dr.
Osinski also has analyzed the actual and potential effects of mergers,
and particularly involving the economic complexities of mergers
involving retail differentiated products.
Prior to joining Bates White, Dr. Osinski was a Senior Economist at
Glassman-Oliver Economic Consultants, Inc. He received his Ph.D. in
Economics from The George Washington University, where he teaches
economics.
