ANDREW EVANS

Principal

Andrew Evans advises clients on how to effectively manage their asbestos claims and other toxic tort liabilities and specializes in helping clients structure financial transactions that mitigate the legal and financial risks. He provides clients and experts with support for insurance coverage negotiations, mergers & acquisitions, liability ring fencing activates, bankruptcy reorganizations, and product liability litigation.

Mr. Evans helps clients disaggregate and determine the exact source of their liabilities—a determination that can have ramifications for corporate restructurings, mergers & acquisitions, liability ring fencing and risk mitigation activates, and potential insurance recoveries. He played a key role in developing Bates White\'s tools for determining the portion of a client’s asbestos expenditures attributable to operations. Recently Mr. Evans helped manage a case dealing with operational insurance coverage for asbestos claims that involved more than $300 million in total available coverage limits. He is currently supporting several clients in their attempts to ascertain the value of any "nonproducts" insurance coverage that might be a part of their historical insurance coverage lines. Mr. Evans has also been helping clients further disaggregate asbestos costs by determining the portion of their payments attributable to the threat of punitive damages and thus potentially exempt from insurance coverage.

Selected Experience

  • Managed a litigation support team for a multibillion dollar bankruptcy of an asbestos-insulation manufacturer. Assessed data quality, reviewed opposing expert′s analytical methods, and developed an independent method for predicting liability categorized as "nonproducts" in insurance policies.
  • Coauthored a report on company-specific asbestos litigation risk in support of a successful corporate divestiture.
  • Advised a client throughout settlement negotiations about the total value of operational and products coverage for a national boiler manufacturer that had recovery claims for silica and asbestos liabilities.
  • Managed asbestos liability due diligence analysis for M&A transactions.
  • Developed plaintiff law firm-specific future asbestos liability forecasts for a multimillion dollar London Market insurance policy settlement negotiation.
  • Assisted in the development of cross-project asbestos site identification procedures, tools, and applications.
  • Assisted in the development of future claim value projection techniques to analyze the effects of bankruptcies on claim values in joint and several tort environments.
