Carolina Czastkiewicz specializes in applied microeconomics and industrial organization. She has experience in all areas of competition policy including price-fixing, monopolization, mergers, vertical integration, and regulation. She has conducted theoretical and empirical analyses of competitive effects and has worked on behalf of corporations, federal agencies, and international organizations, in private litigation, antitrust agency investigations, and international arbitration cases.
Dr. Czastkiewicz earned her PhD in Economics from the University of Chicago with focuses in Labor Economics, Public Finance, and Industrial Organization. Before joining Bates White, Dr. Czastkiewicz was a consultant for the World Bank and a statistical analyst at the Institute of Statistics and Registry of the Construction Sector in Argentina.
Selected Experience
- Evaluated the competitive effects of several mergers on behalf of merging parties and third parties across several industries including agriculture, risk information management, and chemicals. This work involved assisting clients in the preparation of arguments before the intervening regulatory agencies, analysis of intellectual property and vertical issues related to antitrust, as well as empirical analyses of market concentration and valuation models.
- Analyzed vertical restraints and tying claims in the payment processing industry. Supported settlement negotiations with theoretical analysis and empirical quantification of damages of the anticompetitive effects.
- Analyzed price-fixing and monopolization incentives in the context of two-sided markets in litigation in the financial sector.
- Conducted analyses of market definition for healthcare clients. Evaluated the geographic market definition for hospitals using models of patient inflow/outflow and willingness to pay.
- Helped prepare expert comments for the Federal Communications Commission (FCC) on potential vertical integration antitrust issues related to FCC video distribution regulation.
- Worked on the development of a tariff determination model to assist in tariff review negotiations on behalf of Pemex Gas. The model simulates the natural gas transportation system in México.
- Analyzed and quantified the economic impact of the premature termination of a privatization contract in South America. This analysis was included in the expert report filed as part of an international arbitration case at the International Centre for Settlement of Investment Disputes.
