JEFFREY F. BROWN, PhD

Principal

Jeffrey Brown has nearly 20 years of experience as an economist in projects related to litigation and business strategy. His expertise includes empirical analysis of antitrust issues involving exclusionary conduct, strategic pricing, and damages estimation. Dr. Brown has provided expert analysis and testimony for cases in the construction and semiconductor industries and has consulted with businesses on database design, pharmaceutical marketing strategy, IP licensing alternatives, and cost of capital analysis. Dr. Brown currently leads cases focused on healthcare and intellectual property issues.

Prior to joining Bates White, Dr. Brown worked as a Research Analyst at Salomon Brothers and the Federal Reserve Board. He has also served as a consultant to the RAND Corp., Equico Inc., and McKinsey & Co.

Selected Experience

  • Served as one of the lead consulting experts to B. Douglas Bernheim, the testifying expert on behalf of AMD, in the landmark microprocessor antitrust case AMD v. Intel. Advised on case strategy and provided economic expertise to assess the competitive effects of Intel’s alleged exclusionary conduct. The parties reached a settlement that included a $1.25 billion payout to AMD.
  • Served as AMD’s 30(b)(6) witness in AMD v. Intel on topics related to sales and rebate data. Managed discovery-related negotiation, collection, and analysis of data from AMD, Intel, and third parties.
  • Submitted expert testimony regarding the economic impact of the 2005 Gulf Coast hurricanes in a dispute over cost escalation in CH2M Hill Constructors, Inc. v. San Diego County Water Authority.
  • Estimated future royalties from exclusive vs. nonexclusive licensing scenarios for a major equity market exchange. Analyzed implicit royalty rates and developed alternative licensing strategies as part of the summary report and presentation.
  • Evaluated allegations of false advertising in the market for surgical instruments. Responsible for data collection and empirical analyses to estimate the economic impact of alleged conduct for hospital procurement. Supported liability expert report preparation and testimony.
  • Provided economic consulting expertise in a dispute involving disparate racial impact in homeowners insurance premiums. Developed statistical models to detect pricing differentials between protected and unprotected classes and generated alternative risk-adjusted pricing strategies.
  • Investigated the effects of alleged exclusionary conduct on behalf of a medical device manufacturer. Responsible for executing theoretical and empirical analyses to evaluate the effect of bundled rebates. Supported expert testimony related to both liability and damages.
