Bates White’s Cory Capps speaks at AHLA Antitrust Practice Group teleconference
on business strategy and antitrust economics
WASHINGTON DC, February 3, 2009—Cory
Capps, PhD, Principal in Bates White LLC’s Healthcare Practice, participated
in,
“Promise or Problem: Business Strategy and Antitrust Economics of Vertical Integration in Healthcare,”
an AHLA Antitrust Practice Group teleconference on Tuesday, February 3, 2009.
The panel explored the business rationale for and the antitrust economic considerations
of vertical integration, particularly the benefits and problems of vertical integration in healthcare markets.
Dr. Capps related these issues to insurers, hospitals, and physicians and discussed potential
changes in the DOJ’s and FTC’s analytical approaches to vertical relationships. He also
addressed the economic analysis of bundling and tying in light of the 9th Circuit’s decision
in Cascade Health Solutions v. PeaceHealth.
Dr. Capps was joined by Greg Poulsen, senior vice president, Intermountain Healthcare,
and Lawton R. Burns, Professor of Management and Director of the Wharton Center for Health Management and
Economics, University of Pennsylvania. Douglas Ross, Esq., of Davis Wright Tremaine was the moderator.
Dr. Capps has more than 10 years of experience in the analysis of competition in health
care markets and has been involved in merger and civil nonmerger investigations of hospitals,
physicians, nurses, insurers, home health agencies, and ambulatory surgery centers. He
has analyzed joint ventures, group purchasing organizations, price-fixing
and market allocation, and vertical foreclosure. Dr. Capps taught at
the University of Illinois at Urbana-Champaign and at
Northwestern University’s Kellogg School of Management and has published widely.
