Bates White’s Charlie Mullin speaks on economic incentives to litigate asbestos claims
WASHINGTON DC, June 5, 2008—Bates White Partner, Charlie Mullin,
Ph.D., will speak at West Legalworks’ Insurance and Reinsurance Allocation conference in New York NY on June
12, 2008. His presentation, “Impact of Underlying Litigation Developments,” traces the history of
asbestos litigation, examines the current state of asbestos litigation, and highlights trends in the litigation of
mesothelioma cases. Armed with a deep understanding of the litigation environment and significant knowledge of
asbestos products and operations, Dr. Mullin demonstrates the impact that various allocation rulings can have on
insurance recoveries or policy payments. He shows that the ability to forecast potential liabilities and account
for a multitude of possible allocation methods is essential to improved negotiation positions and settlement
outcomes.
Specifically, Dr. Mullin summarizes various methods that can be used to quantify and differentiate non-products
and products claims. He shows how the categorization of these claims plays a central role in valuing insurance
policies that have been issued to companies that installed asbestos-containing products. Further, through a
specific case example, he demonstrates how “site does not equal exposure.” Although there is
uncertainty surrounding the magnitude and timing of future expenditures, the implications and economic impact of
various allocation rulings can be quantified so that companies can make informed decisions.
