Karl Snow, Bates White economist, discusses wage and
hour self-audits at American Conference Institute forum
WASHINGTON, D.C., April 6, 2007—Karl Snow, Principal at Bates White,
LLC, discussed auditing wage and hour data at the American Conference Institute’s Wage & Hour Compliance
conference, in Las Vegas, Nev., on March 26–27, 2007. Snow appeared on a panel entitled, “Achieving and
Maintaining an Effective Compliance Program,” where he discussed how self-audits of wage and hour data are a
key component of the compliance process and can help organizations determine the extent of possible violations,
understand the causes of and remedies for apparent violations, and formulate timely responses to litigation and
regulatory audits.
Snow focused on three aspects of auditing wage and hour data: assessing the accuracy and consistency of the data,
identifying the existence and causes of possible violations, and using wage and hour data to guide compliance
efforts. According to Snow, it is important to understand the relationships among time-stamped data sources because
these data can be used in wage and hour litigation and regulatory audits to establish hours worked and determine
off-the-clock and/or missed break violations. These sources include: timekeeping, security, computer, phone, e-mail,
production and inventory tracking software, cash register, computer-based training, and parking lot records. Snow
explained how patterns in wage and hour data shed light on causes of potential violations and can assist and focus
wage and hour compliance efforts.
Snow has more than 15 years of experience working as an economic consultant specializing in labor and employment
issues, in academia, and in the investment banking and mortgage finance industries. He has consulted on employment
issues involving claims based on the Fair Labor Standards Act (FLSA) and related state laws. He has also evaluated
claims of race, national origin, gender, and age discrimination for employment practices, including salary, total
compensation, bonuses, promotions, performance ratings, hiring, and dismissals.
