Bates White economist Leonardo R. Giacchino featured at South African National Energy Summit
WASHINGTON, D.C., October 5, 2007—Leonardo R. Giacchino, PhD,
Partner at Bates White LLC, had a prominent role at the recent Energy Summit 2007 held by the South African
government’s Department of Minerals and Energy. The Summit took place in Johannesburg, South Africa, on
September 25–27, 2007. Dr. Giacchino was invited by Director General of the Department of Minerals and Energy,
Sandile Nogxina, to serve as Chair of a panel on the “Use of Regulatory Accounts and Open Access Regulatory
System for Transmission Lines.”
Dr. Giacchino also presented three papers at the conference. In “Cost Reflective Tariff Setting Approaches,
” he discusses the basics of cost reflective tariffs (including the revenue requirement standard), the funding
of services through taxes (including policymaking, subsidies, and collection issues), and the question as to whether
ratepayers or taxpayers should pay the tariffs.
In “Appropriate Regulatory Framework to Facilitate Entry of Piped Gas into the Market,” Dr. Giacchino
reviews the South African Natural Gas Case, explains the goals of a Gas Act (development, promotion of growth, and
consolidation), and examines the future prospects for development of the natural gas industry in South Africa.
The third paper presented by Dr. Giacchino, “Improving Governance of the Energy Sector,” explores the
concepts of regulatory independence and discretion in connection with a variety of constituencies, the design of a
regulatory framework, and international best practices in policymaking.

Dr. Giacchino has worked in more than 25 countries on over 100 projects addressing economic and regulatory issues
for U.S. and international businesses, investors, governments, and organizations. He has helped negotiate tariff
adjustments and regulatory reform with politicians and regulators; performed tariff, pricing, and cost studies;
calculated damages and compensation estimates; developed business plans for new regulatory agencies in several
countries; conducted due diligence and feasibility studies for power plants, utilities, and pipelines; and developed
network models for the energy industry. Dr. Giacchino has provided testimony in numerous forums, including U.S.
federal district courts, the London Courts of International Arbitration (LCIA), the International Centre for
Settlement of Investment Disputes (ICSID), and the International Arbitral Center of the Austrian Federal Economic
Chamber. He has participated in proceedings before public utility commissions in Argentina, Australia, Bolivia,
Brazil, Guatemala, Mexico, and Peru. Dr. Giacchino is the coauthor of
Fundamentals of Energy Regulation, published in 2007 by
Public Utilities Reports, Inc.
