Dr. Robert C. Marshall presented at FTC/DOJ hearing on single-firm conduct and Section 2 of the Sherman Act
WASHINGTON, D.C., September 28, 2006—Dr. Robert C. Marshall, Bates White Partner and Head of the Department of Economics at The Pennsylvania State University, spoke at a joint public hearing, “Understanding Single Firm Behavior: Empirical Perspectives,” conducted by the Federal Trade Commission and The Department of Justice. This hearing, the fifth in a series on the topic of single-firm conduct and U.S. antitrust laws, was held on September 26, 2006, at the FTC Conference Center in Washington, D.C.
Dr. Marshall’s talk, “Illuminating Section 2 Through Cartels,” examined monopolization through cartel conduct, explained Porter’s “five forces” that determine profit, and examined Sections 1 and 2 of the Sherman Act through the lens of those “five forces.” He also presented examples of monopolization behavior from four recent cases.
