Dr. Chris Stomberg discussed generic drug competition at Patent Life Cycles conference
WASHINGTON, D.C., July 31, 2006—Chris Stomberg, Ph.D., Principal at Bates White, spoke
at the American Conference Institute’s Maximizing Pharmaceutical Patent Life Cycles conference
held June 13-14 in San Francisco, Calif. Dr. Stomberg focused on a hot topic for drug
companies—the impact of brand drug manufacturers authorizing generic versions of their
drugs to compete with generic manufacturers. Pharmaceutical companies are concerned about the issue
because the Federal Trade Commission recently initiated an 18-month study of the potential
anticompetitive effects of this type of behavior, and it has subpoenaed several manufacturers.
Dr. Stomberg examined how upcoming (2007) changes to Medicaid rebate rules could influence
the decisions of branded drug manufacturers to authorize generic versions of their drugs.
Medicaid rebate changes could, for certain drugs, eliminate the incentive for a manufacturer
to enter the market with an authorized generic drug. As a result, lower-priced generic drugs
could become less available. This could have a dramatic effect on the health care industry and
on consumers. As a result of Dr. Stomberg’s presentation, he was invited by the American
Bar Association to publish a paper on this topic in the ABA’s health care newsletter.
